KOCHI: The non-cooperation of crew members of Enrica Lexie to the probe into the killing of fishermen, will be brought to the attention of the Kerala High Court by the Government of India on Thursday. The court had earlier asked the Central and state governments to file affidavits on a petition filed by Italian Consul General Gian Paolo Cutillo and the two accused - Latorre Massimiliano and Salvatore Girone seeking to quash the FIR. The court will consider the case on Thursday. Reiterating their stand that the Italian marines should be prosecuted in Indian courts, Assistant Solicitor General P Parameswaran Nair in an affidavit pointed out that it is the duty of the state to protect the vital interests of its nationals and uphold the law of the land. “Criminal jurisdiction of the coastal state should be exercised on board a foreign ship passing through the territorial waters to arrest any person or to conduct investigation into a crime committed on board the ship during passage,” the ASG said.  According to Suppression of Unlawful Acts against Safety of Maritime Navigation and Fixed Platforms in Continental Shelf Act 2002, it applies beyond the territorial waters of India and extends to the Exclusive Economic Zone which extends to 200 nautical miles from the base line.
