CHENNAI: The Madras High Court has rejected a plea from a teacher to direct the Don Bosco Matriculation HSS management in Egmore to grant 75 per cent of subsistence allowance pending enquiry into the sexual harassment charges levelled against him.The teacher was ordered to be suspended earlier by the court for his alleged misconduct and sexual harassment towards other teachers and students in the school.Dismissing the petition from Tarmon Fernandez, Justice K Chandru said this case arose under peculiar circumstances. A parent, Srinivas Rajan, filed a petition praying for action against Fernandez and this court, after hearing all the parties, ordered an inquiry and the school management appointed a retired judicial officer as the inquiry officer.The judge said that the suspension was ordered by this court at which time it did not fix any rate of subsistence allowance. Ultimately, it had to be seen whether there was any delay in conducting the enquiry. The school management had taken prompt measures in the inquiry. If at all there was any interdiction, it was neither due to the school management nor due to the petitioner. Hence, there was no legal or enforceable right on the part of the petitioner to claim subsistence allowance. After completion of the enquiry, if no punishment was imposed, the petitioner would get his entire salary. At this stage, it was unnecessary to grant any direction, the judge said.
