In a big relief to Congress’s Dharam Singh Chhoker, the Supreme Court on Wednesday granted him limited protection from arrest in connection to the money laundering case registered against him ahead of the Lok Sabha polls.
The top court has also directed Chhoker to appear before the Enforcement Directorate on April 12.
Senior Advocate Siddharth Luthra along with Advocate Anmol Kheta and AOR Tanya Srivastava argued before the court that the elections are just around the corner.
While hearing a plea seeking quashing of the money laundering case against the Congress leader, the apex court said that Chhoker should appear before ED’s office in Delhi on April 12 at 11 am, and further on any subsequent dates whenever required.
A bench led by Justice Sanjiv Khanna, however, orally granted Chhoker limited protection from arrest, by asking ED to file application before the Supreme Court first if they want to arrest him.
Chhoker’s petition filed through Advocates Tanya Srivastava and Anmol Kheta has pointed out that the predicate offence in the case was quashed by the High Court, subsequent to which ECIR was registered.
The plea has therefore claimed that once the predicate offence did not hold the field there was no question of Proceeds of Crime.
