BANGALORE: The BMS Educational Trust has been accused of violating admission norms by filling government seats under management quota and also by making excess admissions, according to a petition filed in the Lokayukta Court.It was also alleged that crores of rupees were collected without account as donation under management quota, overlooking merit candidates and also by filling up vacancies under various  categories by admitting ineligible candidates.“The deputy secretary has sought an explanation from BMS College of Engineering as to why affiliation should not be withheld/cancelled/ and recommend to the competent authority to bring the institution under ‘no admission category’,” the petition filed by N Venkateshaiah, a 94-year-old resident of Bangalore says in a private case filed on January 23.Apart from former advocate general and chairman of the Council of Trustees B V Acharya, the other accused in the case are the trust’s member appointed by the government H U Talwar, member secretary B S Ragini Narayan and members Dr P Dayananda Pai and former Karnataka additional chief secretary Vijay Gore. The petition also charged that the accused had entered into a criminal conspiracy to fraudulently misappropriate huge sums of money from donations under the management quota and substantial part of the fees collected under various categories. “Pai, who is the prime person in the misappropriation case, has been periodically and unofficially paying huge sums to other trustees, including Acharya and Talwar,  from out of the misappropriated amounts, as reward for cooperation they extended in misappropriation of funds,” the complaint stated.“Acharya, who is accused number one, is enjoying several facilities which are sanctioned to the trustees as well as chairman of the board of management. He is answerable for misappropriation,” the complainant said.It was also alleged that the accused may have preserved the money or converted them into properties or deposited it in bank accounts. “The court should direct a senior officer of Lokayukta to probe  the case,” the complainant said. The court is expected to pass its order on Monday on whether the Lokayukta should probe the case.
