Delhi HC upholds man's 7-year jail term for robbing Rs 700

New Delhi: A man's seven year jail-term, awarded by a trial court for committing a robbery of Rs 700, has been upheld by the Delhi High Court which noted that the convict had also caused severe injuries to the victim.

Dismissing the appeal filed by Sagar against the trial court order, Justice SP Garg relied on the victim's statement and the test identification parade (TIP) report in which he had recognised the accused.

The court also accepted the recovery of weapons - a country-made pistol and a knife - and Rs 700 from the accused.

"The nature of injuries caused to the complainant with the weapon is enough to infer that it was a deadly one. In the light of above discussion, I find no merit in the appeal.

The judgement is based upon fair appreciation of the evidence and needs no interference. The appeal is dismissed," the court said in a recent judgement.

According to the prosecution, Sagar, along with his associate Allauddin, had on November 10, 2009, robbed a man of Rs 700 near Chand Bagh Puliya, Karawal Nagar Road in Khajuri Khas Police Station area in East Delhi.

They had also caused injuries to the victim while committing the offence, the prosecution said.

The trial court had discharged co-accused Allauddin due to lack of evidence, but on July 22, 2010, held Sagar guilty of the offences and sentenced him to seven years in jail.
