New Delhi: Two youths have been sentenced to life imprisonment for murdering a man, who was having an affair with their acquaintance and cheated on her, by a Delhi court which relied on lie detection test and brain fingerprinting reports.
District Judge P S Teji awarded the jail term to Pawan Kumar and Sunder Singh for murdering Delhi resident Ishwar Singh by stabbing him 30 times in November 2001. The court, however, turned down plea of the CBI, which was probing the matter, to give death penalty to the convicts saying the case does not falls in the category of "rarest of rare" case.
"In my considered opinion, while adjudging the facts and circumstances of the present case, it is not a fit case which can be treated to be a case of extreme culpability and there is no other option but to impose death penalty.
"In view of facts and circumstances of the present case, both the convicts Pawan Kumar and Sunder Singh are awarded life imprisonment and fine of Rs 10,000 each for the offence punishable under section 302 (murder) read with section 120B (criminal conspiracy) of the IPC," the judge said.
"The lie detection test reports and brain finger printing reports also corroborate the case of the prosecution," the judge said.
The case was registered against Pawan, Sunder, Dharam Singh, who was discharged by the Delhi High Court, and a juvenile who is facing trial before Juvenile Justice Board.
According to the police, Pawan, Sunder and the juvenile had conspired to kill Ishwar as they had a grudge against him for having an affair with two-three girls at the same time. According to the accused, the deceased was having an affair with the juvenile's sister and also with another girl who was Sunder's tenant and had become pregnant.
