New Delhi: It’s a happy Eid for Dr Mohammmed Haneef as the Federal Court of Australia has upheld a Brisbane judge's decision to reinstate his work visa, indicated that Haneef is free to go back to Australia.
"It's always been Mohamed's wish to come back but he's also concerned of what his wife wants. So I don't think he wants to put himself in a position where she would have to go through the trauma that she went through when he was first detained," said Peter Russo, Haneef's lawyer.
On July 2 , Haneef was detained at the Brisbane airport for allegedly helping terror suspects in foiled terror attacks in UK this year. His detention was extended twice and his visa was cancelled.
The turning point came on July 20, when the Australian police admitted that the crucial evidence linking him to the terror suspects in the foiled UK attack was incorrect.
Since his release, Haneef has continued to fight to clear his name. So now with a favourable decision, will he return to Australia? No, according to his family.
“We are very happy that Haneef won the case in court. Haneef wants to study MD here in India only,” said Ashfaq Ahmed, Haneef's father-in-law.
The Australian government on its part says it does not find any need to appeal against the Federal Court's ruling and Dr Haneef is free to return to the country.
Haneef is currently on his Haj pilgrimage to Mecca.
