KOCHI: The Kerala High Court on Friday issued notice to the state government on a petition challenging the government’s decision to stop the functioning of M A Nisar Commission which was appointed to inquire into the Kasargod police firing case.A Division Bench comprising Chief Justice J Chelameswar and Justice P R Ramachandra Menon issued the notices while considering a petition filed by E K Narayanan, secretary of the All-India Lawyers Union, seeking a directive to quash the notification issued by the government. The Commission was appointed to inquire into the facts and circumstances which led to the incidents at Kasargod town on November 15, 2009. In the firing Muhammed Shafeeque, an IUML sympathiser had died.The petitioner’s counsel advocate C P Sudhakara Prasad pointed out that on June 21 - soon after the state government assumed power - the government issued a notification extending the time period stipulated for the commission to submit its report to January 2012. However within 45 days - on August 4 - the government declared that the Commission shall cease to exist.The petitioner further stated that senior police officers including the then District Superintendent of Police had filed affidavits before the commission stating that there were attempts on the part of IUML workers to incite communal violence in the area. He alleged that the government issued the notification fearing the fallout of a report indicting a party in power. He further contented that the government has acted mala fide and the order is politically motivated.
