The Delhi High Court on Tuesday rejected former Jammu and Kashmir chief minister Omar Abdullah’s plea, seeking divorce from his estranged wife. The bench, headed by Sanjeev Sachdeva and Vikas Mahajan, turned down the plea saying that there was no infirmity with the lower court order which had denied relief to Omar.
The court had earlier directed Omar to pay “interim maintenance” of Rs 1,50,000 per month to Payal Abdullah.
A single-judge bench of Justice Subramonium Prasad had said in August that Omar cannot “abandon his children and ought not to abdicate his duties as a father”.
“This court is of the view that in light of the financial capacity of the Respondent (Omar Abdullah) to provide a decent standard of living to his wife and children commensurate with his income and the standard of living that the Petitioners enjoyed previously, there is no reason that the maintenance amount awarded to Payal Abdullah should not be enhanced to that extent. Accordingly, this court observes that there is limited merit in the instant petition and directs the interim maintenance amount to be increased from Rs 75,000/- per month to Rs 1,50,000/- per month for the petitioner from the date of the application,” Prasad had said.
According to a report in OpIndia, Omar and Payal met when they were employed at The Oberoi Hotel in Delhi. Omar was a young marketing professional in the same hotel chain at that point in time. On September 1, 1994, they got married under the Special Marriage Act and welcomed two boys, Zahir and Zamir.
Payal is a Delhi native with family roots in Lahore, Pakistan. Her father, Major General Ram Nath, was an army officer, the report stated.
