BANGALORE: A city-based advocate, Sirajin Basha, has filed an affidavit in the High Court on Friday stating that the petition filed by former chief minister B S Yeddyurappa seeking to quash the proceedings against him in two cases, be heard and decided by some other judge of the High Court other than Justice B S Patil.Basha, who has filed a five private compliant against Yeddyurappa and his family members under the Prevention of Corruption Act, in his affidavit submitted that certain things had transpired in the writ petition filed by Yeddyurappa, which was being heard by Justice B S Patil.Therefore, the decision in this petition should be heard by another other judge, he said.Basha said “This court (Judge Patil) passed remarks on me stating that the argument is not concluded and I am trying to protract the proceedings, and it is an abuse of process of law. Likewise, some comments are made against my advocate Hasmath Pasha as well. But they were not based on facts.”He further said his advocate, since the day of his first appearance on September 26, argued on merits of the case. But this court (of Judge Patil) directed him to complete his argument by September 29, he said, and added that when he could not complete the argument on the set date, the court posted it for further orders to the next day.The advocate also said there was no delaying tactics adopted by him, but the court granted an interim order in favour of Yeddyurappa only on the ground that delaying tactics had been adopted.
