HYDERABAD: Justice Noushad Ali of the AP High Court declared that expenditure for chemical analysis of bio-products should be borne by their manufacturers itself. He observed that the state government cannot be burdened with the expenditure.The judge made this observation in a batch of writ petitions filed by M/s. Enrich Bio-Tech and others. The petitioners had moved the High court seeking a direction to the authorities not to interfere with the manufacture, sale and distribution of petitioner's bio-products, which contain amino acid and sea-weed extract.It is the contention of the said manufacturers that their products are not governed by the Insecticides Act, 1968 or Fertilizers Control Act, 1985 and therefore there was no obligation on them to obtain the licence under the said statutes. They contend that agriculture department has no jurisdiction to interfere with their business.The authorities pointed out that the action was to ensure that the farmer community does not suffer due to the use of prohibited chemical composition.Justice Naushad Ali directed the manufacturers to submit a sample of 5 kgs of each product with the literature pertaining to the manufacturing process along with compositioncomponents of their products. He also directed them to remit a sum of Rs.5000 to meet the expense of the analysis to be carried out.He directed the authorities to complete the analysis within eight weeks from the date of receiving the samples. If the authorities failed to complete the analysis within eight weeks, it shall be open for the manufacturers to deal with the products.The judge also made it clear that if any complaint was received with regard to the quality of the bio-products it was open for the authorities to take appropriate action.
