CBI against Bihar govt appeal in DA case
The CBI opposed the Bihar government’s appeal against the acquittal of Lalu Prasad and Rabri Devi in the DA case.

New Delhi: The CBI opposed the Bihar government’s appeal against the acquittal of Railway Minister Lalu Prasad his wife Rabri Devi in the Disproportionate Assets case

The CBI contended that only it was empowered to challenge it.

After hearing arguments from the counsel of CBI and Bihar government, Justice Ramesh Kumar Dutta of the Patna High Court issued notice to both Lalu and Rabri Devi on the state government's petition questioning them why it should not be admitted.

Additional Solicitor General Gopal Subramaniam, appearing on behalf of the CBI, which had recently decided not to appeal against the December 18 acquittal of the two, said under the Delhi Police Special Establishment Act, the CBI alone was empowered to appeal against the acquittal of the accused in

cases probed by it.

Referring to sections (5) and (6) of the DPSA, by which the Central investigating agency is governed, Subramaniam said the CBI probed only those cases in which an investigation has been sought by the state government or for which a court has issued a direction.
