Centre clarifies stand on gay sex in SC
The Centre said it has accepted the Delhi High Court verdict of decriminalising gay sex.

New Delhi: The Centre clarified its stand on homosexuality in the Supreme Court on Wednesday saying it accepts the Delhi High Court verdict that decriminalised consensual gay sex. Attorney General GE Vahanvati clarified the Centre's stand in court.

"The Delhi High Court verdict decriminalising homosexuality is acceptable to us," Attorney General GE Vahanvati told the court.

In fact the Centre said criminalising consensual gay sex in private was a violation of the fundamental rights of citizens.

"We learnt and got subsequently enlightened after the HC verdict," the Attorney General added.

There was confusion last month when the Home Ministry took a contrarian view in the court, only to make a U-turn soon after. The Centre's clarification in that context even led the Supreme Court to question the Centre's "subsequent enlightenment".
