KOCHI: The Kerala High Court on Tuesday admitted an appeal filed by the State Government seeking a directive to enhance the life term awarded to the five accused in the Kanichukulangara triple murder case.A Division Bench comprising Justice R Basanth and Justice P Q Barkath Ali also allowed a petition filed by the state seeking to condone the delay of 1,225 days in filing an appeal. Director General of Prosecution Asaf Ali submitted that a lenient view be taken and the delay condoned.However, counsel for the accused opposed the plea. The court observed that the appeals filed by the accused against the conviction are pending before the court.In these circumstances, notwithstanding the inordinate delay in filing the appeal, a lenient view can be taken. So the delay can be condoned and the appeal can be admitted, the court held. It posted the case with other appeals challenging the conviction by the Alappuzha Principal Sessions Court.The appellant submitted that the sentence imposed by the sessions judge against second accused Ajith Kumar alias Saji, third accused Saju alias Mrugom Saju, fourth accused Shibu alias Chief, sixth accused Sajith and seventh accused Himalaya Group MD Bineesh should be enhanced. The govt pointed out that in this case, the life imprisonment should be enhanced to a bigger punishment. The trial court had earlier awarded death sentence to first accused Unni, a lorry driver.
