The Karnataka High Court heard the bail petition filed by French diplomat Pascal Mazurier, who has been arrested for allegedly raping his four-year-old daughter, on Tuesday and adjourned the case for further hearing to September 27.
During the hearing, senior counsel C V Nagesh, representing Pascal, argued that the hospital medical report had indicated that the accused had committed the crime, but the DNA report exonerated him.
He mentioned the recent order of the Delhi High Court, wherein the DNA test on Congress leader N D Tiwari was considered as a base to prove his biological fatherhood of a 32-year-old youth and argued that Pascal’s case too should to be considered on the basis of the DNA test and it should be treated as a proof to explore the truth.
The DNA test in Pascal’s case has come out negative.
Rejecting the allegations made by his wife Suja Jones against Pascal, he contended that there are no direct witness to the alleged rape. “My client is being treated as a carnivorous beast through allegations such as he has indulged in sexually harassing his daughter from past two years, which is far from reality,” he argued.
Nagesh also submitted variation in Suja’s quotes in three different statements which she had given to the police on June 14, 26 and July 21 respectively. “Also, the daughter, who is the only direct witness in the case, has never been brought before the investigating officers so far. Statements by the house maid, cook and car driver attached Pascal’s family indicate innocence of Pascal,” he claimed.
As Nagesh had completed his argument, Justice H N Nagamohan Das adjourned the case for further hearing on September 27. On July 27, the Fast Track Court-I had rejected Pascal’s bail plea observing, “though DNA test does not match with the DNA profile of the accused, bail cannot be granted to him only on this ground.”
