New Delhi: The Supreme Court on Tuesday expressed its anguish over illegal occupation of Government bungalows by politicians and political parties.
A Bench comprising Justice B N Aggrawal and Justice D K Jain stated that the Government lacked the will and guts to take action against influential persons since it involved vote bank politics.
"What will you do with political parties and other big people. You don't have guts because it concerns your vote bank. You hang the peon and leave the big people," the apex court observed, while dealing with the issue of unauthorised occupation of Government accommodation.
It wondered what action the Government proposes to take against political parties and political leaders who have been alloted Government bungalows for their use.
"A politician once enters a bungalow doesn't leave. Time would come when most of these houses will become memorials," the Bench observed.
Many former ministers are still residing in bungalows that were allotted to them when they were ministers. They have not moved out despite several notices.
Many present ministers also face accusations of making illegal unauthorised constructions in their allotted homes.
The apex court took exception at the failure of the Central Government to file an affidavit to explain its position on amending Section 441 IPC (criminal trespass) to invoke the provision against those in unauthorised occupation of official bungalows.
The court will hear arguments on Wednesday on whether an offence under Section 441(IPC) should be made non-bailable or not.
