NEWDELHI/KOCHI: The Supreme Court on Tuesday  stayed a Kerala High Court order sentencing CPM leader M V Jayarajan to six months’ imprisonment for making offensive remarks against judges and granted him a conditional bail which includes furnishing a bond of Rs 10,000.A Bench of Justice R M Lodha and Justice H L Gokhale, however, expressed serious concern over the behaviour of Jayarajan ridiculing the performance of two High Court judges in public and making derogatory remarks.“Justice cannot be taken to street. It is not acceptable. These things should stop. These are not good things,” the Bench said.“We are upholders of the rule of law. High Court is a constitutional court. This is something extraordinary and unacceptable, to say the least,” the Bench said.The Bench also showed displeasure over the High Court decision for immediate implemention of its order leading to his arrest and not granting the politician time to approach the apex court.“In judicial process you cannot take away the right of a person,” the Bench said, adding, “He (Jayarajan) is not above law but he cannot be denied his legitimate right”.The apex court also came down heavily on the CPM for protesting in front of the Kerala High Court on Monday against the court verdict. The Supreme Court asked how can they (CPM) protest against a constitutional verdict. The case was posted for next hearing in July 2012.Taking a strong view of offensive remarks made against judges and the judiciary by Jayarajan, the High Court had on November 8 sentenced him to six months’ imprisonment for contempt of court.The High Court, which had initiated suo motu contempt proceedings against Jayarajan, had turned down his plea to suspend the sentence to enable him to file an appeal in the Supreme Court. Immediately after the order was passed, police personnel took him to Thiruvananthapuram Central jail.
