The Supreme Court on Friday refused to hear the bail petition of Jawaharlal Nehru University Students' Union president Kanhaiya Kumar and asked his lawyers to move the Delhi High Court.
SC said that if they take up the matter, it will give a wrong message that no other court other than the apex court is capable of hearing the case. As Kanhaiya's lawyers, Soli Sorabjee and Raju Ramachandran, pleaded that there is a threat to his life in Patiala House Court, the SC observed that if he does not feel safe going to Patiala House Court, in this "extraordinary situation", they can approach the Delhi High Court. "We will ask the Delhi High Court to take up Kahaniya's bail case," the SC said.
SC said that it will not hear the bail petition at this stage specially when the government of India and Delhi Police is ready to provide security to him.
His lawyers have the liberty to seek urgent hearing in the case but it will be the prerogative of the HC whether it allows them the time. They can move the HC on Friday itself if the formalities in the SC are completed.
Meanwhile, the Delhi Police also submitted s their report in SC on the violence that took place in Patiala House Court on February 15 when Kanhaiya was produced in court. Delhi Police did not oppose the bail plea of Kahaniya Kumar in principle, however, they raised objection to not following the procedure and coming straight to SC.
Police has also said that they are ready to provide more security to Kahaniya.
