HC Judge recuses from BSY petition

BANGALORE: High Court Judge B S Patil recused himself from hearing a petition filed by former chief minister B S Yeddyurappa seeking to quash proceedings in the lower court, following an affidavit by the complainant, Sirajin Basha, seeking a change of the bench. However, the court has directed the registry to initiate a contempt proceeding against the complainant for making factually incorrect submissions on the affidavit sworn before the Court. “In order to uphold the standards of the Judiciary, I have no hesitation to say I do not intend to hear the matter,” he observed. Earlier, Supreme Court senior counsel Anup Chowdary submitted that the plea for recusal should not be taken seriously and by recusing from the case, the dignity of the court will be enhanced. “This is not a case where the court should be offended,” he had contended.
